1. Acceptance of Terms

By accessing or using Design Build Source ("DBS", "the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Platform. These terms apply to all visitors, homeowners, and registered professionals.

2. Platform Description

DBS is an information and directory platform that provides construction intelligence, professional listings, suburb data, and build planning tools for the Australian residential construction market. DBS is not a building contractor, architect, or construction company. We do not carry out construction work and are not party to any agreements between homeowners and professionals.

3. User Accounts

You must be 18 years or older to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised access at hello@designbuildsource.com.au.

4. Professional Listings

Professionals who list on DBS warrant that all information provided is accurate, current, and not misleading. Licence information must reflect actual current licence status. DBS verifies licence data against public registers at time of listing; ongoing accuracy is the professional's responsibility. DBS may remove or suspend listings that are found to be inaccurate or misleading.

5. Disclaimer of Warranties

The Platform is provided "as is" without warranty of any kind. DBS does not warrant that: (a) information on the Platform is accurate, complete, or current; (b) the Platform will be uninterrupted or error-free; (c) any professional listed will complete work to a satisfactory standard. Cost estimates, DA data, and material prices are indicative only and do not constitute professional advice.

6. Limitation of Liability

To the maximum extent permitted by Australian law, DBS excludes all liability for any loss or damage arising from use of the Platform, including but not limited to: reliance on cost estimates or DA data; disputes between homeowners and professionals; decisions made based on professional profiles or reviews. Our total liability to you in any calendar year shall not exceed AUD $100.

7. Intellectual Property

All content on the Platform (excluding user-submitted content and publicly sourced data) is owned by or licensed to DBS. Professional portfolio images remain the intellectual property of their respective owners. By uploading content to the Platform, you grant DBS a non-exclusive licence to display that content for the purpose of operating the Platform.

8. Prohibited Conduct

You must not: scrape or systematically download Platform data; use the Platform to send unsolicited communications; submit false or misleading information; attempt to bypass security measures; use the Platform in any way that violates Australian law. DBS reserves the right to terminate access for any violation of these terms.

9. Subscription and Payments

Professional subscription fees are billed monthly or annually via Stripe. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are not provided for partial months. DBS may change subscription pricing with 30 days' notice to registered email addresses. All prices are in Australian dollars and include GST where applicable.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. These Terms constitute the entire agreement between you and DBS regarding the Platform.
